Income Tax Notice, Online Response, Appeals & Pending Compliance Assistance

Receiving an Income Tax Notice does not always mean that additional tax is payable or that there has been a serious violation. A notice may arise due to an income mismatch, TDS/TCS difference, non-filing, transaction verification, tax demand or other compliance requirements.

The first step is to understand the reason for the notice, the information required, the response deadline and the documents needed.

Income Tax Notice

What is an Income Tax Notice?

An Income Tax Notice is an official communication from the Income Tax Department asking a taxpayer to provide information, clarification, documents or take a specific action.

A notice may relate to:

  • Income Tax Return filing
  • Income or TDS/TCS mismatch
  • High-value transactions
  • Foreign income or assets
  • Refund verification
  • Tax demand
  • Non-filing or delayed filing
  • Assessment or reassessment
  • Deductions or exemptions
  • Other pending compliance

Common Types of Income Tax Notices

Notices may be issued under different provisions, depending on the matter. Common examples include Section 139(9), 143(1), 143(2), 148 and 156, along with other notices or communications issued by the Department.

The appropriate response depends on the notice and the taxpayer’s records.

What to Do for a Notice Under Section 139(9)?

A notice under Section 139(9) may be issued when an ITR contains incomplete or inconsistent information. The taxpayer generally gets 15 days from receipt of the notice or the time specified in the notice to rectify the defect.

Common reasons may include:

  • TDS claimed without reporting the related income
  • Mismatch between receipts and TDS information
  • Missing Balance Sheet or Profit & Loss details, where applicable
  • Incorrect or incomplete ITR information

If the defect is not rectified within the prescribed time, the return may be treated as invalid.

Online Response to Income Tax Notice

Many notices can be responded to through the Income Tax e-Filing portal under e-Proceedings.

The process generally involves:

  1. Reviewing the notice
  2. Identifying the issue
  3. Checking the relevant ITR and records
  4. Preparing an explanation
  5. Uploading supporting documents
  6. Submitting the response within the prescribed time
  7. Tracking the proceedings

Income Tax Appeals

If a taxpayer disagrees with an appealable order or demand, an appeal may be filed before the appropriate appellate authority within the prescribed time.

This may involve reviewing the order, preparing grounds of appeal, compiling documents and responding to further communications.

Pending Income Tax Compliance

Pending matters may include:

  • Unfiled returns
  • Outstanding tax demands
  • Pending notice responses
  • TDS/TCS mismatches
  • Incorrect return information
  • Pending rectification
  • Other unresolved matters on the Income Tax portal

Timely Response is Important

Every notice should be reviewed carefully and responded to within the specified time. Ignoring a notice may lead to further proceedings or other consequences depending on the matter.
