Income Tax Return Filing For Individuals
Income tax filing in India is a direct tax which is levied on the income and profit of individual or organization. It covers all income like salary, pension, PPF, rental income, the capital gain on sale of immovable property/movable property/shares/mutual funds, interest, royalty, technical fee, profit from business/profession, etc.
An individual may have income from salary, business or profession, house property, capital gains, interest, dividends, foreign sources or other sources. Depending on the nature and amount of income, the applicable ITR form and tax treatment may differ.

What is Income Tax Filing?
Every individual (resident or non-resident) who earns income whose either source is in India or that income is received in India is liable to pay tax in India. That person shall file an annual income tax return to report that income and pay his tax liability (if any) in India.
Filing income tax return in India becomes mandatory when income exceeds the exemption limit.
For non-residents, residential status and the source of income are particularly important because Indian taxability can differ depending on whether the income is received, accrued or earned in India or outside India.
What are the Benefits of Income Tax Filing?
Nonresidents shall opt to income tax e-filing India:
- To claim a refund of extra withholding tax,
- To report his income even if it is exempt especially when the purpose is to remit funds out of India
- To claim to carry forward of loss.
- To maintain clean and clear records with the Indian Income Tax Department.
- To validate credit worthiness before financial institutions to access bank loans/credits.
For individuals, filing the correct ITR is also important for properly reporting income, claiming eligible deductions or tax credits, carrying forward eligible losses and maintaining an accurate tax record.
Income That May Need to Be Reported
Income tax filing is not limited to salary income. Depending on the individual, the return may include income from several sources:
Salary or Pension
Salary, pension, bonus, allowances and other taxable components may need to be reported based on the applicable provisions.
House Property
Rental income and income or loss from house property may need to be reported. Interest on eligible housing loans may also have tax implications depending on the applicable tax regime and conditions.
Capital Gains
Profit or loss arising from the sale of property, shares, mutual funds and other capital assets may be taxable under the applicable capital gains provisions.
Business or Professional Income
Individuals carrying on a business or profession may need to report turnover, expenses, profits and other relevant financial information. The applicable ITR form and disclosure requirements depend on the nature of the activity.
Other Sources
Interest income, dividends and other taxable receipts may also have to be included in the return.
Foreign Income and Assets
Residents may have additional reporting requirements in relation to foreign income and specified foreign assets. The reporting requirements depend on the individual’s residential status and the nature of the foreign income or asset.
Documents and Information Required for ITR Filing
The documents required depend on the individual’s income sources. Commonly required information includes:
- PAN and Aadhaar details
- Form 16 for salary income
- Form 16A for applicable non-salary TDS
- Annual Information Statement (AIS)
- Taxpayer Information Summary (TIS)

The AIS and TIS should be reviewed before filing because the information available with the Income Tax Department may contain details of interest, dividends, securities transactions, TDS/TCS and other reported transactions.
How to File Income Tax Return?
The Income tax return can be filed by creating an account on the income tax e filing portal. To create it, a person shall have a PAN number. An easy income tax filing India can be done either filing an ITR online or by uploading XML generated through utilities available on the income tax e filing portal.
The correct ITR form should be selected depending on the nature of income, residential status and other applicable conditions.
How is Income Tax Applicable?
In the case of individuals tax is levied based on income slabs.
Income tax is generally calculated after identifying the different sources of income, applying the relevant provisions, allowing eligible deductions or exemptions where applicable, and determining the taxable income.
The tax liability is then calculated according to the applicable tax regime and rates. TDS, TCS, advance tax and other eligible tax credits are adjusted against the final tax liability.
If excess tax has already been paid, the taxpayer may be eligible for a refund. If there is a balance tax payable, the applicable amount needs to be paid as per the prescribed provisions.
New Tax Regime – Tax Slabs
| Taxable Income | Tax Rate |
| Up to ₹4,00,000 | Nil |
| ₹4,00,001 – ₹8,00,000 | 5% |
| ₹8,00,001 – ₹12,00,000 | 10% |
| ₹12,00,001 – ₹16,00,000 | 15% |
| ₹16,00,001 – ₹20,00,000 | 20% |
| ₹20,00,001 – ₹24,00,000 | 25% |
| Above ₹24,00,000 | 30% |
For eligible resident individuals, the rebate under Section 87A under the New Tax Regime can be up to ₹60,000, where taxable income does not exceed ₹12 lakh, subject to the applicable conditions.
A standard deduction may also be available to eligible salaried individuals and pensioners as per the applicable provisions.
Old Tax Regime
The Old Tax Regime continues to be available to eligible taxpayers. It follows a different tax structure and allows certain deductions and exemptions that are restricted or not available under the New Tax Regime.
For example, depending on eligibility, deductions and exemptions relating to items such as:
- Certain investments and payments
- Life and health insurance
- Eligible education loan interest
- Housing loan interest
- Certain allowances and exemptions
- Other deductions specifically permitted under the applicable provisions
may be considered under the Old Tax Regime.
Therefore, the decision between the Old and New Tax Regimes should not be based only on the slab rates. The individual’s salary structure, investments, housing loan, insurance, eligible deductions, exemptions and overall income should be considered before selecting the appropriate regime.
For individuals without business or professional income, the regime can generally be selected while filing the return, subject to the applicable rules and conditions.
When is the Income Tax Return Filed?
The income Tax return is filed after the end of the financial year in which income is earned.
The due date for filing an Income Tax Return depends on the taxpayer’s category, nature of income, applicability of tax audit and other conditions prescribed for the relevant year.
For Tax Year 2026-27, different due dates applied to different categories of taxpayers, and certain due dates were also extended by the Income Tax Department. Therefore, taxpayers should always check the applicable due date for the relevant assessment year instead of relying on a fixed date.
